Moyers noted that decreasing the vehicle category pound range could not be implemented at tire Sonoila and Tubac facilities due to the absence of scales.

Vice-Chairman Maynard stated that he has received several complaints regarding discrepancies at the Sonoita and Tubac facilities due to the absence of scales.

Public Works Director, Victor Gabilondo stated that it would not be cost effective to place scales at the Sonorta and Tubac facilities.

Carol DeFazio stated that Mr. Moyers has been doing an excellent job supervising the operations and maintaining the appearance of the landfill; however, she feels that the discrepancies are caused by the fee shed attendants. Mrs. DeFazio suggested that the Board postpone action on this item to give the fee shed attendants the opportunity to adhere to the policy and fee structure.

An action item regarding this issue will be placed on the 5/13/03 Board of Supel visors' Agenda.

Board of Supervisors May 13, 2026 9:30 a.m.

The Board met in a Regular Meeting at the Santa Cruz County Complex, 2150 N. Congress Drive, Room #120, Nogales, AZ. Present: Manuel Ruiz, Chairman; John Maynard, Vice-Chairman; Robeit Damon, Supervisor~ Greg Lucero, County Manager; Holly Hawn, Attorney; Melinda Meek, Clerk. Also present: Jennifer St. John, Victor Gabilondo, Carol DeFazio, Carol Cullen, Dave Verwys, Sheriff Estrada, Leonard Fornes, Ramon Romo, Louie Chaboya, Karl 0. Moyers.

The Meeting was called to order and the Pledge of Allegiance was recited, led by Carol DeFazlo.

ADOPTION OF AGENDA: Supervisor Damon made a motion to adopt the Agenda as posted; second by Vice- Chairman Maynard; motion carried unanimously.

CALL rO THE PUBLIC: Carol DeFazio, on behalf of the Rio Rico Property Owners Association, addressed the Board regarding the proposed increase in landfill fees, suggested that no changes be made at this time and that the issue be reviewed at the end of the fiscal year.

Dave Verwys, Tubac Chamber of Commerce, requested that any proposed sale of County assets, specifically land in the Village of Tubac, be postponed to give the community time to study the implications of such a sale.

Chairman Ruiz asked for clarification as to what land Mr. Verwys was referring to; Mr. Verwys responded that he was referring to the Agenda item regarding the possible abandonment of a portion of County right of way on Plaza Road.

Mr. Verwys also informed the Board that there his been a change in the Tubac Board of Directo[s and submitted a letter of continued support for a special events ordinance.

Chairman Ruiz acknowledged receipt of documentation from Richard Simpson, President, International Border Relations, regarding the Copper Canyon Train Project.

REPORTS:

BOARD OF SUPERVISORS: Chairman Ruiz wished all mothers present, a belated Happy Mother's Day.

MANAGER: County Manager, Giegg Lucero, reported that he attended the Arizona City Managers' Conference and a Finance Conference last week; he also attended the ACC Hearing rcl~,aidmll utility rates.

Attorney Hawn provided the Board with an update on the utility rate hearing with the /\Aizona Cotporation Commission , all parties were instructed to submit closing arguments in writing it) the Adunnistiative Law Judge by 6/15~ the AdministrativeLaw Judge will review submitted material, make his decision and forward it to the Arizona Corporation Commission.

FINANCE: Finance Director, Jennifer St. John, reported $3,002,388 in the General Fund; $1,438,126 in the Road Fund; $353,456 in the Flood Control District Fund; $6,602,120 total for all funds; $3,069,388 estimated end of month balance, compared to $2,828,393 cash at May 2002, a difference of $240,995.

SHERIFF: Sheriff Estrada reported that the current jail population is 67, 60 males and 7 females; 13 inmates have been sentenced to the County jail and 3 to the Arizona Department of Corrections; 59 have been charged with felonies and 8 with misdemeanors; 10 (15%) are undocumented aliens; 3 have been committed to the County jail on a daily basis and 5 on a weekly basis. 62 persons were booked in during the past week; 182 total calls for service were received, of which 41 were 911 calls.

Sheriff Estrada stated that he has not received a response to his request for a Study Session with the Board to discuss "the crisis at the Sheriff's Department".

Sheriff Estrada challenged comments made to the Nogales International regarding someone's perception that senior officers of the Sheriff's Department are accepting employment elsewhere due to morale problems. Sheriff Estrada stated that a 10-year senior officer at the Sheriff's Department making $30,000 recently accepted employment with the City of Nogales Police Department at an entry- level salary of $30,000,

Sheriff Estrada challenged the Board to be visionaries and make a difference in public safety; he stated that the Board's desire to address salaries for all County employees is a noble gesture but the Board needs to focus on this issue because it is the important issue facing Santa Cruz County at this time, Sheriff Estrada requested that the Board not look for reasons not to address Sheriff's Department salaries but look for reasons to do it.

Sheriff Estrada requested that the Board direct staff to be creative and come up with a resolution to this matter,

Chairman Ruiz stated that a Study Session regarding this issue has tentatively been scheduled for 5/27. Chairman Ruiz stated that mandated budget cuts are a major concern.

ACTION ITEMS:

CHANGE IN POUNDS RANGE - LANDFILL: Solid Waste Department Manager, Karl Moyers, stated that staff has identified 2 ways to adjust the residential rate; increase the flat rate in the small and large pickup truck categories from $4 & $6 to $6 & $8 across the board at all 3 facilities or adjust the weight structure.

Staff recommends that the Board approve the adjustment of the weight structure as follows: a minimum charge of $2 for all loads less than 120 tbs.; a minimum charge of $2 for residential cars less than 120 tbs; a minimum charge of $4 for a residential small pickup truck (bed high, between 120 & 250 tbs and less than 1.67 cubic yards); a minimum charge of $6 for a residential large pickup truck (bed high, between 250 & 400 tbs and less than 2.63 cubic yards).

Mr. Moyers stated that such a change in weight structure would result in an additional $30,000 in revenue only at the Rio Rico Landfill due to the lack of scales at the other facilities; if approved, staff recommends an effective date of 7/1/2003.

Attorney Hawn suggested that a public hearing be held regarding this issue if the Board is inclined to approve staff's recommendation.

Supervisor Damon made a motion to direct staff to develop a Resolution and proceed with the public hearing process; second by Vice-Chairman Maynard; motion carried unanimously.

ABANDONMENT OF A PORTION OF COUNTY RIGHT OF WAY-PLAZA ROAD: Public Works Director, Victor Gabilondo, stated that in 8/2002, he received a letter from the Law Offices of Castro & Ziff requesting that the County vacate a small portion of fight of way along Plaza Road in Tubac; based on investigation by the County Engineer, there is approximately 722 sq. feet of right of way that almost bisects the propertyowner's property; vacating the small triangular portion would still leave 60 feet of right of way along Plaza Road.

The Public Works Department has no objection to this action. Mr. Gabilondo stated that this proposed abandonment would not affect the Tubac Historic Zone. The 60-day required posting began I week ago; staff is requesting direction from the Board whether to continue with the posting process.

Dave Verwys stated that since the posting went up there has been considerable concern voiced in the Village of Tubac regarding the implications of such a sale and businessowners have requested an opportunity to further study the matter prior to Board action.

Attorney Hawn informed the Board that they have no authority to take action on this issue at today's meeting; the final decision would come back to the Board at the end of the 60 day posting period; the Board could direct staff to continue with the posting process or not.

County Manager, Greg Lucero, stated that due to the concerns expressed by the Tubac Chamber, this issue was brought before the Board to determine if there is support to continue with the process.

Vice-Chairman Maynard noted that the financial implications identified by staff is $722 and asked how this figure was derived; Mr. Lucero responded that this is a minimum price and is based on the assessed value.

Chairman Ruiz asked if the Board would be required to sell the property if the posting process continues; Attorney Hawn responded that she will review the matter; Mr. Lucero responded that the posting states that the Board is considering disposing of the property and does not bind the Board in any way.

Supervisor Damon made a motion to direct staff to continue with the posting and to schedule a Study Session to review the issue prior to the final decision; second by Vice-Chairman Maynard; motion carried unanimously.

BONDS FOR DUPLICATE WARRANTS #2-162840 payable to Mike's Auto Glass, Inc., dated 6/18/02 in the amount of $179.28 and #4-546589 payable to E2020 Inc., dated 2/3/03 in the amount of $13,045.13 were approved as submitted. (RD/JM; c.u.)

ARIZONA AUTOMOBILE THEFT AUTHORITY 2003-2004 GRANT AGREEMENT: Major Romo informed the Board that the Sheriff's Office recently submitted a grant proposal to the Arizona Automobile Theft Authority for $20,000; $400,000 were available but due to the high volume of requests, Santa Cruz County only received $3,000; no local match is required and the grant will provide overtime funding to deter vehicle theft in Santa Cruz County.

Supervisor Damon made a motion to approve as presented; second by Vice-Chairman Maynard; motion carried unanimously.

The Special Meeting was called to order, recessed to Executive Session at 3:31 p.m. and reconvened at 3:45 p.m. (JM/RD; c.u.)

NATIONAL CENTURY FINANCIAL ENTERPRISES, INC., BANKRUPTCY: ViceChairman Maynard made a motion to authorize Gibbs & Bruns to file a lawsuit or other necessary action related to claims arising from the National Century Financial Enterprises, Inc., bankruptcy on behalf of Santa Cruz County with a 30-day option to opt out; second by Supervisor Damon; motion carried unanimously.
